In accordance with the Law of the People’s Republic of China on Import and Export Commodity Inspection and its implementation regulations, the General Administration of Customs has decided to adjust the list of import and export commodities subject to inspection. The announcement is hereby made as follows:
Add customs supervision condition “B” to 29 10-digit customs commodity numbers related to export fertilizer, and the customs shall carry out export commodity inspection on related commodities.
This notice will come into effect on October 15, 2021. See annex for the regulatory requirements after adjustment.

Customs interpretation: What is a statutory inspection? Is statutory inspection limited to catalogue goods?

According to the Law of the People’s Republic of China on Import and Export Commodity Inspection and its implementing regulations, the customs shall carry out inspection on the import and export commodities listed in the catalogue of legal inspection as well as other import and export commodities subject to customs inspection as stipulated by laws and administrative regulations, namely statutory inspection.

The scope of statutory inspection is not limited to import and export commodities listed in the list of legal inspection, but also includes other import and export commodities that are subject to customs inspection according to laws and administrative regulations. For example, according to the Regulations on the Safety Management of Hazardous Chemicals, the Customs shall carry out inspection on import and export hazardous chemicals and their packaging.

Customs interpretation: What aspect problem does export trade concern need to notice?

Article 5 of the Law of the People’s Republic of China on Import and Export Commodity Inspection stipulates that export commodities listed in the catalogue are not allowed to be exported without passing the inspection.

When handling export business, the relevant export trade party shall go through customs inspection formalities in time for 29 products with 10-digit Customs commodity numbers newly transferred into the catalogue and involving export chemical fertilizers, and reserve sufficient time to avoid delay in delivery.

It is suggested that the relevant parties of export trade take the initiative to collect the mandatory requirements of the technical specifications of relevant products, or consult the local competent customs to ensure that the export commodities meet the requirements.
